Term of Service

Article 1 – Definitions

Within these General Terms and Conditions, the following terms shall have the meanings set out below:

Withdrawal Period
The period during which the consumer may exercise the right to withdraw from a purchase.

Consumer
Any natural person acting for purposes outside their trade, business, or profession who enters into a distance contract with Margaret, Mary & Martha.

Ongoing Agreement
A distance contract relating to the delivery of products and/or services over a period of time.

Right of Withdrawal
The consumer’s statutory right to withdraw from a distance contract within the applicable withdrawal period.

Business
Margaret, Mary & Martha, offering products to consumers through online sales.

Distance Contract
An agreement concluded between the consumer and Margaret, Mary & Martha by means of online communication.

CESOP
The Central Electronic System of Payment Information used within the European Union to monitor payment service providers.

Please Note: The business address is not a return address. Returns must be requested and approved through our customer service team before being sent back. Please do not return products to a business or correspondence address unless specifically instructed to do so by our customer service team.

Article 3 – Applicability

These General Terms and Conditions apply to all offers, orders, and agreements concluded between Margaret, Mary & Martha and the consumer.

Before any agreement is finalized, these terms are made available electronically to the consumer.

Article 4 – Offers and Pricing

All product listings and offers on the website are non-binding. Margaret, Mary & Martha reserves the right to modify prices, product availability, promotions, and product details at any time.

Prices shown include the product price and, where applicable, shipping costs. Any import duties, taxes, customs charges, or courier fees imposed by authorities are the responsibility of the customer unless explicitly stated otherwise.

Article 5 – Formation of the Agreement

An agreement is formed once the customer places an order and payment has been successfully completed.

From this point forward, the order is considered final and cannot normally be cancelled. The agreement becomes legally binding on both parties at the moment of payment confirmation.

Return requests may only be submitted after the order has been delivered, in accordance with the applicable return provisions and any mandatory consumer rights.

Article 6 – Right of Withdrawal

Where a statutory right of withdrawal applies, consumers may exercise that right within the legally applicable withdrawal period after receiving the product.

Return shipping costs are borne by the consumer unless applicable law requires otherwise or Margaret, Mary & Martha agrees otherwise.

Article 6a – Final Sale Items

Products purchased with a discount of 40% or more are classified by Margaret, Mary & Martha as final sale and are not eligible for ordinary returns or exchanges, except where mandatory consumer protection laws provide otherwise or where the product is defective, damaged, or materially incorrect.

Items discounted by less than 40% may be eligible for return, subject to the conditions set out in our Return & Refund Policy.

Article 7 – Refunds and Return Costs

If a return is approved, Margaret, Mary & Martha will process the applicable refund after the returned item has been received and inspected.

Returned products must comply with the conditions specified in our Return & Refund Policy, including requirements regarding condition, wear, packaging, and return authorization.

For approved returns where permitted by applicable law, a $15 restocking and handling fee per item may apply and will be deducted from the refund amount.

Article 8 – Customs, Duties, and Taxes

The consumer is responsible for any customs duties, import taxes, and compliance with applicable local import regulations unless otherwise stated during checkout.

Margaret, Mary & Martha does not act as the importer of record for international shipments unless expressly stated otherwise. Charges imposed by customs authorities or courier services may therefore be the responsibility of the customer.

Customs processing and clearance times are outside our direct control.

Article 9 – CESOP Compliance

Where applicable, payment service providers may report transaction information through the European Union's CESOP system in accordance with their legal obligations.

Margaret, Mary & Martha complies with applicable legal obligations concerning payment and transaction information.

Article 10 – Product Compliance and Warranty

We aim to ensure that products correspond with the descriptions and images provided on our website.

If an item arrives defective, damaged, or materially different from what was ordered, the customer should contact info@margaretmarymartha.com as soon as reasonably possible after delivery.

We may request photographs or other information reasonably necessary to assess the issue before providing an appropriate resolution.

Article 11 – Delivery

Orders are processed and delivered according to the estimated timeframes provided in our Shipping Policy.

Delivery estimates are not guarantees. Delays may occur due to carriers, customs procedures, severe weather, transportation disruptions, peak shipping periods, or circumstances outside our reasonable control.

Customers are responsible for providing complete and accurate delivery information and, where applicable, fulfilling customs and import requirements.

Article 12 – Complaints

Complaints should be submitted by email to info@margaretmarymartha.com as soon as reasonably possible after the customer becomes aware of the issue.

Please include the order number and sufficient information for us to investigate the complaint.

Margaret, Mary & Martha aims to respond to complaints within 14 days. If additional time is required, the customer will be informed accordingly.

Article 13 – Governing Law and Disputes

These Terms and Conditions are governed by applicable laws of the United States, subject to any mandatory consumer protection laws that may apply to the customer.

Any dispute should first be addressed through mutual consultation in an effort to reach an appropriate resolution.

Nothing in these Terms and Conditions is intended to exclude, restrict, or override rights that cannot legally be excluded under applicable consumer protection law.
